Finding jurors who state they can be open mined won't be a challenge. Folks that can put their life on hold for the months/years this will take. A bit trickier. And can you imagine being a New Yorker, not voting guilty, and being able to safely return home?
I wouldn't be surprised to see the jury trail rights waived by the defense. And instead turn the trial into procedural and what gets, and does not, get admitted.
Torture and Miranda only comes into play if the evidence was discovered because of the torture. Heck, unless this guy is completely broken he might decide to turn this into a chance to brag to his brotherhood.
The previous administration didn't do pursue a trail. We may well find for good political, if not legal, reasons. In the end they choose to address the issue by just letting it stink for the next guy in charge.
In theory I'd prefer a crimes against humanity Hague sort of thing. Are we going to just start keeping people indefinitely without ever moving forward. Much as it seems practical for this loon, it's the wrong thing to do systemically.
What I fear is that the circus is coming to town. I hope I am wrong.
And if this case is lost. That is cost a lot of votes.
